By using Alark, you agree to these terms. They're written in plain English — please read them.
By downloading, installing, or using the Alark mobile application ("App") or website at alark.app ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Alark. These Terms apply to all users of the App and Site.

You must be at least 13 years old to use Alark. By using the App, you represent that you are 13 or older. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
You agree to use Alark only for lawful purposes and in a way that does not infringe the rights of others. You must not:
You retain ownership of the videos and content you create on Alark ("User Content"). By recording and sending a video through Alark, you grant us a limited, non-exclusive, royalty-free license to store, transmit, and display that content solely for the purpose of operating the App — specifically, delivering your video to the intended recipient's alarm.
You are solely responsible for the content you create. We do not pre-screen User Content but reserve the right to remove content that violates these Terms or our community guidelines.
You represent that you have all necessary rights to the content you submit and that your content does not violate any third-party rights or applicable laws.
We reserve the right to remove any User Content and suspend or terminate any account that we determine, in our sole discretion, violates these Terms or is otherwise harmful to users or the Alark community. We are not obligated to monitor all content but may do so.

Your use of Alark is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
Alark is an alarm application. By enabling alarms, you acknowledge that the App may play sounds and display content on your device at scheduled times, including when your device is locked or in Focus mode, if you have granted the necessary permissions. You are responsible for configuring your alarms appropriately.
The Alark name, logo, bird icon, and all related trademarks, service marks, and trade dress are the property of Ryan Morabito. You may not use these marks without prior written permission. The App's design, code, and content (excluding User Content) are protected by copyright and other intellectual property laws.
Alark uses third-party services including Firebase (Google), Apple Sign In, and Google Sign In. Your use of these services is subject to their respective terms of service. We are not responsible for the practices of these third-party services.
ALARK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not warrant that alarms will fire at the exact scheduled time in all circumstances. Alarm delivery depends on device settings, operating system behavior, network conditions, and permissions granted by the user. We recommend not relying solely on Alark for time-critical situations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALARK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Alark and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.
We may suspend or terminate your access to Alark at any time, with or without notice, for any reason including violation of these Terms. You may delete your account at any time from the Profile screen in the App. Upon termination, your right to use the App ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, via push notification or email. Continued use of Alark after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Connecticut.
